Sometimes debt collectors engage in clearly inappropriate and abusive conduct, which goes beyond the bounds of decency and would justify calling a lawyer and seeking damages (see the list of common violations). But what if you just want to stop repeated telephone calls? The law permits you to stop these calls by simply writing a "cease contact" letter.
California and federal law together require both professional debt collectors and creditors to stop virtually all contacts with you upon receipt of the letter. Be aware, however, that sending such a letter may increase the risk that the debt collector or creditor will sue you, or make adverse credit reports. Such letters typically trigger an internal review of legal options. On the other hand, they might simply close the file.
The Trueblood Law Firm has prepared the following sample "cease contact" letter for California consumers. You use the letter at your own risk, there is no guarantee of good results, and there is no attorney-client relationship created between you and the Trueblood Law firm. If you decide to use the form, carefully fill in the bracketed blanks with your particular information. Send it by certified mail and keep the receipt. If the calls still don't stop, please contact us for a consultation.

Re: [your name and debt collector's account number(s) for your debt(s)]
Dear [debt collector]:
Pursuant to my rights under the state and federal fair debt collection laws, I hereby request that you immediately cease all written and oral contact with me, and my family and friends, concerning any and all alleged debts you contend I owe. See California Civil Code § 1788.17 (requiring compliance with 15 U.S.C. § 1692c(c) by both professional debt collectors and creditors).
My employer prohibits me from receiving your calls or letters at work, and such contacts are embarrassing and inconvenient for me. Therefore, please also refrain from contacting my workplace in any manner.
Thank you for your cooperation in this matter.
Sincerely,
[your name]
